Thank you for choosing Baja Charters. Everything is included, if you are on a Whale Shark Encounter, an Espiritu Santo Island Adventure, Remote Beaches Excursion, an Expedition for Mobula Rays, or joining an “In Search of the Giant Mantas” shared tour.

If you have chartered an entire yacht for your party, as opposed to joining a shared tour, your charter details are set forth in the Private Charter Agreement. Baja Charters represents a substantial inventory of third-party owned yachts, some of which have unique terms that are set forth in the Private Charter Agreement.

Our professional bi-lingual crews provide outstanding food and drink options, an onboard chef, lay-out areas, private bathrooms, fresh-water showers, towels, snorkel gear, wetsuits, and where required, an assistant snorkel boat with a licensed snorkel leader. Kayaks, paddle boards, and other water features are available when and where permitted, in order to make your adventure a truly epic Lifetime Experience.

Company
Baja Charters & Excursions, S de RL de CV is a Mexican Limited Liability Company. Baja Charters is the company’s marketing and operating name. Baja Charters is a licensed nautical commercial charter company, and a legal Naviera, which allows the company to represent commercially licensed third-party, foreign-flagged yachts.

Ground Transportation
Shared tour guests may use the shuttle transportation contracted on your behalf, subject to availability. An amount equal to 15% of the published tour pricing goes to the contracted ground transportation provider. If you elect to drive to the marina on your own, and are booking online, use promo code 37483. It will deduct the entire 15% from the published rate. Shuttle pickup and return is along the Los Cabos corridor, including MOST hotel and resort lobbies. Baja Charters is not responsible for conflicts with contracted ground transportation companies.

Private charters may decide to include private ground transportation from a residence, hotel or resort to a chartered yacht, for an amount set forth in the Private Charter Agreement.

Deposits and Payments
To schedule a shared tour or Baja Cat private charter booking 90 days or more in advance, a deposit of 50% of the total is required. If your activity date is less than 90 days before departure, 100% of the fee is to be paid before booking.

For private charters, other than Baja Cat, a 30% to 50% deposit is required to book the yacht you have selected for private charter. Deposit amounts vary from yacht to yacht. Payment terms are as set forth in the Private Charter Agreement.

Deposits are non-refundable, but full credit against future use is provided if your travel plans are changed for emergency reasons.

Substitution
Shared tours are typically done from a comfortable sailing catamaran. Other yachts may be substituted as needed for yacht maintenance, schedule conflicts, etc. We reserve the right to use other licensed yachts to fulfill a shared tour or private charter as circumstances may require.

Discounts
Returning guests receive a 10% discount on shared tours, or on private charters booked online at www.BajaCat.com. If booking online use the discount Promo Code 738876, it will deduct 10% from the published online rates.

Guests booking shared tours that prefer to use their own ground transportation to and from the appropriate marina in La Paz receive an 15% discount per person. If you booking online, and driving on your own, the discount Promo Code is 37483. Discounts are not available on third-party owned yachts.

Crew Tips
Crew tips are normally a choice made by guests relative to the quality of services provided. Crew tips go directly to the captain and are split evenly with crew after guests depart the boat. Crew tips are normally paid in cash in either pesos or dollars directly to the captain. A credit card may be used, but its use will incur 16% Mexican tax plus a 4% processing charge.

When booking private groups of 20 guests or more. A minimum crew tip of 12% will be added to the published or quoted rates, unless assurances are provided as to crew gratuities.

Overnight and extended multi-day and night charters require a crew tip minimum of 12%.

Mexican Tax
On 1 January 2014, the Mexican government increased the IVA tax (Sales Tax on all Mexico transactions) to 16%.

Cancellations and Rescheduling
You may cancel your shared tour or private charter 5 days or more prior to your tour activity date and reschedule, subject to availability, anytime within a 3-year period.

Whale Shark Activity
Swimming with whale sharks is one of life’s great outdoor experiences. However, four federal agencies have overlapping jurisdiction regarding whale shark activities. Without notice, any one of them can interrupt this outstanding snorkel experience. Federal regulators have tightened restrictions for guests entering the whale shark park, and although this created some logistical impact in the 2025-26 season, we were able to get virtually everyone into the whale shark park, other than the occasional port closure. We expect these tightened regulations to continue through the 2026-27 legal whale shark season.

The impact of fluctuating federal requirements may affect park entry, and whether guests are allowed to swim with a whale shark. If this happens, and a park closure is not for weather reasons, affected guests receive a potential 2 for 1 benefit. Each affected guest receives a whale shark certificate to go out at a future date when the whale shark park is reopened AND may join an additional shared tour activity for FREE in the interim that is open and available.

Damages
Guest damage to yachts, boats, and/or loss of equipment will be charged to the booking purchaser at replacement cost, plus 25%.

Refunds
If maintenance issues, or anything within the normal control of Baja Charters, prevent you from enjoying your booked cruise date, we will provide you with an alternative date that works within your travel plans, or refund your money completely.

Baja Charters is not responsible for the Port Captain closing the Port, government edict, or in the case of whale shark excursions, changes in bureaucratic regulations without adequate notice. However, in these situations, we provide you with an alternative date that works within your travel plans, provide an alternative excursion, and/or issue you an assignable, three-year certificate to go out at a later date.
